Serving Delaware's Manufactured Housing Industry
Welcome to First State Manufactured Housing Associations' (FSMHA) website. FSMHA works to maintain and enhance the climate for sound growth of the manufactured housing market in Delaware, thereby assuring that its citizens have the opportunity to participate in and enjoy the privilege of home ownership. The end result will be a better served and satisfied consumer, and a strengthening of the industry as a whole.

 

Highlights about some of our programs and projects.


Delaware’s Relocation Trust Fund

The “Trust” was established in accordance with Manufactured Home Owners and Community Owners Act in August of 2003. The Trust Fund provides financial assistance to the tenants in a manufactured home community where the community owner changes the use of the land or converts the manufactured home community to a condominium or cooperative community.

Delaware Manufactured Relocation Trust Fund (“Trust Fund”) established pursuant to 25 Del. C. §7012. The Relocation Trust Authority was established by the Delaware Legislature pursuant to 25 Del. C. §7011. The primary purpose of the Authority is to: (a) provide financial assistance to manufactured homeowners who are tenants in a manufactured home community where the community owner changes the use of land or converts the manufactured home community to a condominium or cooperative community; and (b) to provide financial assistance to manufactured home community owners for the removal and/or disposal of non-relocatable or abandoned manufactured homes when there is a change in use or conversion. The Authority has set an initial $3.00 monthly assessment for deposit into the Trust Fund. Under the statute, one-half of the monthly assessment is the obligation of the Tenant of a rented lot and one-half of the assessment is the obligation of the Landlord. The monthly assessments collected by the Authority are deposited into the Trust Fund, and the Authority is responsible for administering this fund. To carry out its statutory responsibilities, the Authority has been directed to, among other things, establish procedures under which applicants for payment from the Authority may be approved and to set maximum benefits that may be payable to applicants under certain circumstances.

 

Common Ground
Forum designed for manufactured homeowners who live in a land-lease community and community owners and mangers to discuss issues of common interest. Forums are held once per quarter in each county. Dialogue has been informative and respectful.


Landlord-Tenant Dispute Resolution Project, “CLASI Manufactured Housing Enforcement Fund”, established by four community owners’ contributions totaling $96,000. Manufactured homeowners and community owners are concerned about alleged poor business practices occurring in Delaware’s manufactured housing industry. Both parties are concerned about the negative impact of these allegations and hope this fund will support resolving issues to their mutual satisfaction. Coordinated by Community Legal Aid Society, Inc. and will be available summer of 2006.
